When the family is doing the talking

In immigration, criminal defense, and personal injury, the first contact with a South Florida firm is often not the client. It is a daughter, a wife, a brother. An intake with one name field does not know who it is talking to, and everything after it goes to the wrong person in the wrong language.

We are not attorneys and this is not legal advice. Who the firm may speak with about a matter, and what it may say to a relative, is a confidentiality question for the attorney; this piece is about capturing the information the attorney needs to make that call.

Three inquiries that look like one

  • A mother fills out the form at 9:41 PM because her son was arrested. She writes in Spanish. He speaks English, and he is the one in custody.
  • A daughter calls about her father’s accident. She has his phone. He is in the hospital and does not text.
  • A wife writes about her husband’s immigration case. The petitioner is her; the beneficiary is him; the documents are in a drawer at her mother’s house.

A form with a single "Name" and a single "Phone" records the mother, the daughter, and the wife as the prospective client, in whatever language they wrote, and sends every message after that to them. The consultation reminder goes to the mother in Spanish; the son, who will attend, never sees it. The document list goes to the daughter; the father, who has the documents, is not on the thread.

TWO PEOPLE, TWO LANGUAGES

The intake needs four things: who is writing, who the matter is about, how to reach each of them, and which language each one uses. The person writing may be Spanish-dominant and the person with the matter English-dominant, or the reverse. One language field is not enough.

What the form asks

LegalCRM.pro’s intake forms carry a field for the relationship: "I am writing for myself" or "I am writing for someone else," and if the second, who, how to reach them, and their language. It is one extra question. It changes which name goes on the pipeline card, which contact receives which message, and which language the voice agent opens with when it calls back.

What the firm decides

Capturing both people is not the same as talking to both. Whether the firm may discuss the matter with the relative, and how much, is the attorney’s call, and for a person in custody or in a hospital the relative is often the only channel. What the system does is make the choice visible: the card shows both names, and the attorney decides who is the client and who is the contact. The confidentiality of what either one shared is protected under Rule 4-1.18 from the first message, whether or not the firm is engaged.

The reminder that went to the wrong person

The failure mode is small and constant. The consultation reminder goes to the mother, in Spanish, at 8 AM. The son, who is the one attending, was never on the thread, and misses it. The firm records a no-show. Nobody did anything wrong except the form, which had one name field.

In the voice agent

The same distinction applies on the phone. When a caller says "I am calling about my husband," the agent takes the caller’s name and number and the husband’s name, notes the relationship, and does not ask for or discuss the facts. If the husband is in custody, the call escalates to an attorney on the path the firm set up. The relative gets a confirmation in their language; the attorney gets both names.

Does capturing a relative's name make them a client?

No. The form records who is writing and who the matter is about so the firm can decide who the client is and who is a contact. Who the firm may discuss the matter with is the attorney's call under the confidentiality rules.

Which language do the messages go out in when two people are involved?

Each person's language is captured separately. The confirmation goes to the person attending in their language; the document list goes to the person gathering documents in theirs. One language field for the whole inquiry is what causes the wrong-person, wrong-language failure.
