Criminal defense intake at 2 AM: the call is from his mother

An arrest does not keep business hours, and the person calling about it is rarely the person charged. The intake has to answer at 2 AM, in her language, take the charge and the custody status, and get an attorney on the line before the bond hearing. Here is what that build looks like.

Who is calling, and when

The arrest was at 1 AM. By 2 the family knows, and someone is on a phone looking for a lawyer: a mother, a spouse, a brother, often Spanish-dominant, often with the charge half-understood and the county wrong. They will call three firms. The first one whose phone does something useful is the one they retain, and "useful" at 2 AM means a human being within minutes, or a voice that clearly gets them to one.

WHAT USEFUL MEANS AT 2 AM

The call is answered on the second ring. The voice offers Spanish or English on the first turn. It says it is automated and recorded. It asks whether the person is in custody now. If yes, it takes the caller’s name and number, the name of the person charged, the charge and county if known, and says an attorney will call back within the window the firm set, then it pages that attorney. It does not ask what happened and it does not say what will happen.

Two escalations, tested before go-live

  • In custody. A yes to "is he in custody now" pages the on-call attorney by text and call, creates the card at the top of the board with an escalation flag, and tells the caller the callback window. The caller gets a confirmation text, in their language, with the firm’s number.
  • Hearing tomorrow. "Court in the morning" or "bond hearing" triggers the same page. A first appearance is hours away, and a message in the morning inbox is too late.

Both paths are built and tested with a real call before the agent takes a live one. A firm that says "we will add the escalation later" has an agent that takes messages at 2 AM, which is a voicemail with better manners.

What the form and the card carry

The charge, the arresting county, custody status, bond if set, the next court date, and both names: the caller and the person charged, with the relationship. A card with "DUI, Miami-Dade, in custody, bond hearing 9 AM, mother calling in Spanish" is a card an attorney can act on from a phone. A card that says "new lead" is not.

What the reply may say

Nothing about the case. Not "this sounds like a misdemeanor," not "he will probably be out by morning," not "we handle DUIs all the time and win." The first is advice, the second a prediction, the third a Rule 4-7.13 problem, and the person on the line is frightened, which is Rule 4-7.15’s concern. The template says the firm handles this, an attorney is being reached now, and here is the number to call back. Calm, short, in her language.

After the first night

The retainer conversation in criminal defense happens fast, often within a day, and the fee is usually flat or a deposit. The follow-up sequence is short: the agreement, a reminder the next morning, then a person. The mother who called is usually the one paying, and the fee explanation goes to her, in Spanish, with the client’s name on the card as the client.

Does the agent ask what happened?

No. It takes the caller's name and number, the name of the person charged, the charge and county if the caller knows them, and custody status. The facts wait for the attorney, which keeps the transcript free of matter detail and the agent clear of giving advice.
